1. Eligibility and Authority

You must be at least 18 years old to use the Services.

If you are using the Services on behalf of a company or organization, you represent that you have authority to bind that entity to these Terms. 
Govafy is designed for US based users and organizations. If you are using the services, you represent that you are a US based user.

 

2. Description of Services

Govafy provides software solutions with AI-powered tools to assist with proposal drafting, editing, management, and analysis for government contracting and professional services.

The Services are intended to support users, not replace professional judgment, legal advice, or compliance responsibility.

 

3. Account Registration and Responsibilities

To access certain features, you must create an account.

You agree to:

Provide accurate and complete information

Maintain the confidentiality of your login credentials

Promptly notify us of unauthorized access

Be responsible for all activity under your account

Govafy is not responsible for losses caused by unauthorized account use.

 

4. Acceptable Use

You agree not to:

Use the Services for unlawful, fraudulent, or deceptive purposes

Upload or process classified information

Interfere with or disrupt the Services or security features

Reverse engineer, scrape, or attempt to extract source code or models

Use the Services to violate procurement laws or regulations

We may suspend or terminate access for violations of these Terms.

 

5. User Content and Ownership

Your Content

You retain ownership of all proposals, documents, and content you upload or generate using the Services (“User Content”).

By using the Services, you grant Govafy a limited, non-exclusive, royalty-free license to process, store, and display User Content solely to provide and support the Services.

Confidentiality

We treat User Content as confidential and do not claim ownership over it.

 

6. Artificial Intelligence and Generated Content

Govafy uses artificial intelligence to generate content based on user inputs.

You acknowledge that:

AI-generated content may be inaccurate, incomplete, or outdated

Outputs are not guaranteed to comply with solicitation requirements

You are responsible for reviewing, validating, and submitting all content

Govafy does not guarantee proposal awards, compliance outcomes, or evaluation results.

 

7. No Professional or Legal Advice

The Services do not provide legal, procurement, compliance, or financial advice.

You are solely responsible for:

Proposal accuracy and completeness

Compliance with applicable laws, regulations, and solicitation terms

Final submissions and representations to government agencies

 

8. Fees, Subscriptions, Payments, and Refunds

Certain features require a paid subscription.

You agree to:

Pay all applicable fees according to your selected plan

Provide accurate billing information

Authorize recurring charges where applicable

All fees are non-refundable unless otherwise stated in writing.

We may change pricing with reasonable notice.

Each plan is designed to support a typical government contracting workload. If your usage grows beyond what’s included, additional capacity can be added without disrupting your work.

Govafy may temporarily pause heavy usage to ensure platform stability. You’ll always be notified before this happens.

​You may cancel at any time; payments are non-refundable, but your subscription will remain active through the end of the current billing period.

 

9. Third-Party Services

The Services may integrate with or rely on third-party providers (e.g., cloud hosting, AI infrastructure, analytics).

Govafy is not responsible for third-party services and does not control their terms or policies.

 

10. Data Privacy

Our collection and use of personal data is governed by our Privacy Policy, which is incorporated by reference.

 

11. Suspension and Termination

We may suspend or terminate your access if:

You violate these Terms

Your use poses a security or legal risk

Required by law

You may terminate your account at any time.

Upon termination, your access will end, and data may be deleted in accordance with our Privacy Policy.

 

12. Intellectual Property

Govafy and its licensors own all rights to the Services, including software, interfaces, logos, and trademarks.

You may not use Govafy branding without prior written permission.

 

13. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GOVHQ DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICES WILL BE ERROR-FREE, UNINTERRUPTED, OR SECURE.

 

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

GOVAFY SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR SPECIAL DAMAGES, INCLUDING LOST PROFITS, LOST CONTRACTS, OR PROCUREMENT OUTCOMES.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO GOVAFY IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM.

 

15. Indemnification

You agree to indemnify and hold harmless Govafy from claims arising out of:

Your use of the Services

Your User Content

Your violation of laws, regulations, or these Terms

 

16. Governing Law and Venue

These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law principles.

Any disputes shall be resolved exclusively in state or federal courts located in Georgia.

 

17. Changes to These Terms

We may update these Terms from time to time. Updated Terms will be posted with a revised effective date.

Continued use of the Services constitutes acceptance of the updated Terms.
